1. Acceptance of Terms

By accessing or using the Better Listed platform at getbetterlisted.com (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Better Listed LLC, a Delaware limited liability company (“Better Listed,” “we,” “us,” or “our”).

2. Description of Service

Better Listed is a software-as-a-service platform that provides AI-powered photo enhancement and virtual staging tools designed for real estate professionals. Users upload property photographs, and the Service uses artificial intelligence to enhance image quality, adjust lighting and color, and generate virtual staging of rooms and spaces. The Service is intended to help real estate agents prepare listing photos for marketing materials, MLS listings, and other promotional uses.

3. Account Registration

To use the Service, you must create an account by providing a valid email address. Authentication is handled through a magic link sent to your email; no password is required. You are responsible for maintaining access to the email address associated with your account and for all activity that occurs under your account. Each individual may maintain only one account. You must not create multiple accounts, share your account with others, or transfer your account to another person. You must be at least 18 years of age to create an account and use the Service.

4. Subscription and Billing

Access to the Service requires a paid monthly subscription at a rate of $50.00 per month (USD). All payments are processed securely through Stripe. Your subscription begins on the date you complete checkout and automatically renews each month on the same calendar day until canceled. You authorize Better Listed and Stripe to charge your designated payment method on a recurring monthly basis.

You may cancel your subscription at any time through the billing portal accessible within your account. Cancellation takes effect at the end of the current billing period; you will retain access to the Service until that period expires. No partial-month refunds are issued. Better Listed reserves the right to change subscription pricing with at least 30 days’ written notice to your registered email address. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Upload, transmit, or process any content that is illegal, obscene, defamatory, threatening, or that violates any applicable law or regulation.
• Upload photographs or other content to which you do not hold the necessary rights, licenses, or permissions, including content that infringes the copyright, trademark, or other intellectual property rights of any third party.
• Resell, sublicense, redistribute, or commercially exploit the Service or any output generated by the Service to operate a competing product or service.
• Attempt to reverse engineer, decompile, or extract the source code or underlying algorithms of the Service.
• Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable use or places an undue burden on our infrastructure.
• Misrepresent AI-generated virtual staging as actual photographs of physically staged properties in any context where such a distinction is material or required by law.

Better Listed reserves the right to suspend or terminate your account if we reasonably determine that you have violated this section.

6. Intellectual Property

You retain full ownership of all photographs and other content that you upload to the Service (“User Content”). By uploading User Content, you grant Better Listed a limited, non-exclusive, royalty-free license to process, transform, and store your content solely for the purpose of providing the Service to you. This license terminates when your content is deleted from our systems.

Better Listed and its licensors retain all rights, title, and interest in and to the Service, including all software, algorithms, user interface designs, trademarks, logos, and documentation. Nothing in these Terms grants you any right to use the Better Listed name, logo, or branding except as necessary to identify the source of the Service.

7. AI-Generated Content

The photo enhancement and virtual staging results produced by the Service are generated using artificial intelligence technology. While we strive for high-quality output, AI-generated results may contain inaccuracies, visual artifacts, or imperfections. Enhanced and virtually staged photos are provided “as is” and should be reviewed by the User before publication or distribution.

AI-generated virtual staging is not a substitute for professional photography or physical staging. Better Listed does not guarantee that AI-generated content will meet specific quality standards, comply with MLS or advertising regulations in your jurisdiction, or accurately represent the physical condition of any property. You are solely responsible for ensuring that your use of AI-generated content complies with all applicable laws, regulations, and industry standards, including any disclosure requirements for digitally altered images.

8. Privacy

Your privacy is important to us. Our collection, use, and handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understand the Privacy Policy and consent to the practices described therein. Uploaded photographs are stored on secure, S3-compatible cloud infrastructure and are accessible only to you and to our systems as necessary to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BETTER LISTED LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF BETTER LISTED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BETTER LISTED’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO BETTER LISTED IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BETTER LISTED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Termination

You may terminate your account at any time by canceling your subscription through the billing portal and contacting us at [email protected] to request account deletion. Better Listed may suspend or terminate your account at any time for cause, including but not limited to a breach of these Terms, non-payment, or conduct that we reasonably believe is harmful to other users or to the integrity of the Service.

Upon termination, your right to access the Service ceases immediately (or, in the case of a voluntary cancellation, at the end of the current billing period). We will retain your uploaded photographs and processed images for a period of 30 days following account termination, during which you may contact us to request a data export. After this 30-day period, all User Content will be permanently deleted from our systems. Provisions of these Terms that by their nature should survive termination—including Sections 6, 7, 9, and 12—will continue in full force and effect.

11. Modifications to Terms

Better Listed reserves the right to modify these Terms at any time. When we make material changes, we will notify you by sending a notice to the email address associated with your account at least 15 days before the changes take effect. We will also update the “Effective Date” at the top of this page. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
